WEBSITE-WIDE MASTER TERMS & CONDITIONS

Introduction

Welcome to Fit Escapades (“Company”, “we”, “us”, “our”). By accessing or using our website www.fitescapades.com (“Website”) or purchasing any product, package, retreat, or getaway (“Services”), you (“User”, “Guest”, “Customer”) agree to be bound by these Terms & Conditions.

These Terms apply to all visitors, users, members, and customers engaging with our platform.

Jurisdiction: Mumbai, Maharashtra, India.

Eligibility

  • Minimum age: 18 years old.
  • If booking for a minor, the guardian assumes full responsibility.
  • Customers must be medically fit to travel and participate in relevant activities.
Nature of Services

Fit Escapades operates as:

  1. A curated travel marketplace for Wellness Getaways (fixed-length hotel packages).
  2. A retreat organiser for Signature Fitness Retreats.
  3. An operations partner for Partner Retreats.
We act either as:
  • Principal organiser (Signature Retreats), OR
  • Marketing & booking platform (Wellness Getaways), OR
  • Operations partner (Partner Retreats).
This will always be disclosed on the product page.

Role & Liability Disclaimer

  • For Wellness Getaways, Fit Escapades acts ONLY as a marketing and booking facilitator. Actual services are delivered by the hotel/resort (“Supplier”).
  • For Partner Retreats, Fit Escapades assists the Retreat Leader/Coach/Brand but is not responsible for program changes, cancellations, or on-ground activities delivered by the partner.
  • For Signature Retreats, Fit Escapades is responsible for the retreat design; however, third-party services (transport, hotel, trainers, activities, meals, equipment, etc.) remain the responsibility of each Supplier.
Fit Escapades is NOT liable for:
  • Supplier failure, delays, overbooking, strike, weather, injuries, illness, or acts of God.
  • Personal loss, theft, damage, or force majeure events.
  • Guest negligence, misconduct, medical complications, or failure to disclose health conditions.
Pricing & Taxes
  • Prices are dynamic and may change without prior notice.
  • GST and taxes apply as per Indian law or are included as disclosed in each offer.
  • Price includes only what is expressly mentioned in the inclusions.
Payments
  • 100% advance payment required unless otherwise stated.
  • EMI/Payment plans—if offered—must be paid on time.
  • Failure to pay instalments may lead to cancellation without refund.
All payments are accepted online via secure gateways.

Voucher Codes & Promotions

  • Promo codes are non-refundable, non-transferable, and subject to availability.
  • Cannot be clubbed unless explicitly allowed.
  • Fit Escapades may withdraw offers anytime.
Health, Medical & Safety

Guests must:

  • Disclose medical conditions.
  • Obtain medical clearance for fitness-intensive retreats.
  • Carry personal medication.
  • Follow trainer/supplier safety instructions.
Fit Escapades will not be liable for injuries resulting from negligence or undisclosed medical issues.

Behaviour & Conduct

Fit Escapades reserves the right to remove any participant (without refund) for:

  • Intoxication or drug use
  • Abuse, harassment, or disruptive behaviour
  • Violation of hotel/retreat rules
  • Threat to self or others
Intellectual Property

All content, branding, itineraries, and media remain the intellectual property of Fit Escapades.

Amendments

Fit Escapades may modify these Terms anytime. Updated Terms will be published on the Website.

Jurisdiction

Any dispute shall be subject exclusively to the courts of Mumbai, India.

Wellness Getaways – Terms & Conditions

Fit Escapades (“Company”, “we”, “our”, “us”) operates holiday packages (“Wellness Getaways”) curated in partnership with hotels, wellness centres, resorts, fitness providers, nutritionists, spas, instructors, and other third-party service providers (“Partners”).

By booking a Wellness Getaway through Fit Escapades (website, WhatsApp, email, social media, or offline), you (“Guest”, “Traveller”, “Customer”, “Participant”) agree to be bound by these Terms & Conditions.

Please read them carefully before making a booking.

Definitions

“Wellness Getaway” means a fixed-length hotel or resort package combining accommodation with wellness and/or fitness inclusions such as spa treatments, yoga, meditation, nutrition, wellness consultations, activities, meals, and experiences.
“Partner Property” means the hotel, resort, retreat centre, spa, therapist, instructor, or service provider offering services within the Wellness Getaway package.
“Package Inclusions” are the specific benefits listed for a particular getaway (rooms, meals, spa sessions, transfers, activities, etc.).
“Non-refundable Components” include pre-booked spa appointments, wellness consultations, third-party services, government taxes, processing fees, and other costs defined herein.

GENERAL CONDITIONS OF BOOKING

By booking a Wellness Getaway, you confirm that you have:

  • Read and understood these T&Cs;
  • Read the specific inclusions/exclusions of the selected package;
  • Read the cancellation and refund rules applicable to the package;
  • Accepted that Fit Escapades acts as a facilitator/aggregator and not as the direct provider of hotel, spa, wellness, or activity services.
All bookings are subject to availability at the Partner Property.

Booking confirmation is issued only upon:

  • Receipt of full payment (or partial deposit, if applicable); and
  • Partner Property reconfirmation.
Fit Escapades reserves the right to decline or cancel any booking at its sole discretion.

Pricing, Taxes & Payment Terms

Prices are dynamic and may change until the time of payment.
All charges are quoted in INR unless stated otherwise.
Prices are inclusive of applicable GST where required; however, some Partner Properties may charge additional local taxes, resort fees, or service charges payable directly at the property.
Payments are accepted via UPI, bank transfer, credit/debit cards, or any approved online method.
Booking fees, gateway charges, currency conversion fees, and platform fees are strictly non-refundable.

Cancellation, Amendment & Refund Policy

This applies specifically to Wellness Getaways.

Cancellations by the Customer

Unless otherwise stated on the specific getaway page:

  • Refunds will be provided only if cancelled in writing 30 days prior to the check-in date. 
Non-Refundable Components (always applicable)

Regardless of cancellation window, the following are always non-refundable:

  • Spa/wellness treatments pre-booked with third-party providers
  • Wellness consultations, sessions, or therapy appointments
  • Taxes collected on behalf of the government
  • Payment gateway fees
  • Fit Escapades service/processing fees
  • Special promotions, flash deals, or festive-period packages
  • Early check-in/late checkout upgrades
  • No-show charges from hotels or partners
Amendments
  • Date changes or amendments are subject to availability and Partner Property approval.
  • Amendment fees may apply.
  • If the property rate increases for new dates or has seasonal surcharge applicable, the Guest must pay the difference.
No-Shows & Early Departures
  • No refund will be provided for no-shows.
  • No refund for unused inclusions, missed meals, missed sessions, or early check-out.
Cancellations by Fit Escapades or Partners

In rare circumstances where Fit Escapades or the Partner Property must cancel a booking:

  • A full refund of the package amount will be issued; OR
  • The Guest may opt for a credit voucher valid for 12 months; OR
  • An alternative property/package may be offered (subject to Guest approval).
Fit Escapades is not liable for any additional expenses including flights, visas, transfers, or incidental costs arising due to cancellations.
Wellness, Medical & Health Liability

Guests must confirm they are medically fit to participate in wellness activities, including but not limited to:

  • Yoga, stretching, meditation
  • Fitness or movement sessions
  • Spa therapies
  • Sauna/steam/ice or heat-based experiences
  • Nature walks, light treks, or outdoor activities
Guests with pre-existing health conditions (cardiac, respiratory, orthopedic, chronic illness, allergies, pregnancy, etc.) must:
  • Seek advice from their physician before participating
  • Inform Fit Escapades and the Partner Property
  • Sign a health declaration
Fit Escapades is not liable for:
  • Injuries, illnesses, allergic reactions, side effects of treatments
  • Therapist errors, treatment outcomes, or dissatisfaction with wellness services
  • Medical emergencies, accidents, or health complications before/during/after the getaway
Partner therapists and wellness practitioners operate independently. Fit Escapades is not responsible for their conduct or professional actions.

Guests participate voluntarily and at their own risk.

Force Majeure

Fit Escapades is not responsible for cancellations, delays, or modifications caused by events outside our control, including but not limited to:

  • Natural disasters, weather conditions
  • Epidemics, pandemics, government restrictions
  • Strikes, labour disputes
  • Property shutdowns or operational issues
  • Accidents, technical failures, or unsafe conditions
Refunds/credits in such cases will be governed by Partner Property policies.

Fit Escapades Role & Liability Limitation

Fit Escapades acts solely as a curator, coordinator, and booking facilitator.
Fit Escapades does not own, manage, or control Partner Properties or wellness service providers.
Fit Escapades is not responsible for:

  • Hotel services, room quality, food safety, hygiene, maintenance
  • Spa or wellness service quality
  • Staff behaviour or delays
  • Activity quality, cancellations, modifications
  • Any loss, theft, accident, damage, injury, death, or misconduct
Maximum liability of Fit Escapades, under any circumstance, is limited to the amount paid by the Guest for the package.

Guest Responsibilities & Conduct

Guests agree to:

  • Follow all property rules and wellness guidelines
  • Respect other guests and staff
  • Avoid disruptive, unsafe, or illegal behaviour
  • Not bring banned substances or hazardous items
  • Not engage in harassment, abuse, or disrespect at the property
If a Guest violates conduct rules, Fit Escapades or the Partner Property may remove the Guest without refund.

Special Requests

We will pass on special requests (dietary, room type, accessibility) to the property, but these are not guaranteed.

Travel Insurance

Fit Escapades strongly recommends that all Guests purchase:

  • Travel insurance
  • Medical insurance
  • Wellness activity coverage
  • Cancellation protection
Guests without insurance assume full responsibility for risks.

Intellectual Property & Media Release

During the getaway, Fit Escapades may capture photos/videos/feedback for marketing.
By participating, Guests grant permission to use such media for promotional purposes unless they opt out in writing.
All content (text, photo, video, branding, itineraries) remains proprietary to Fit Escapades.

Privacy & Data Protection

For Wellness Getaways, Fit Escapades may collect sensitive personal information including:

  • Medical conditions
  • Dietary requirements
  • Wellness preferences
  • Emergency contact details
  • ID proofs
This data is used solely to facilitate the wellness experience and may be shared with Partner Properties on a need-to-know basis.

All data is handled in accordance with the Fit Escapades Privacy Policy and applicable Indian data protection laws.

Governing Law, Disputes & Jurisdiction

These Terms are governed by the laws of India.
All disputes shall first be attempted to be resolved through mediation.
Failing mediation, courts in Mumbai, Maharashtra shall have exclusive jurisdiction.

Amednments to Terms

Fit Escapades reserves the right to update these Terms at any time. Changes will apply to future bookings and will be published on our website.

Signature Fitness Retreat – Terms & Conditions

Introduction
These terms and conditions outline the agreement between you (“Participant/Traveller/Guest”) and Fit Escapades (“Company”, “we”, “our”, or “us”) regarding your participation in our fitness retreats. By booking and attending a retreat, you accept and agree to adhere to these terms.

Booking and Payment

  • A full payment is required to confirm your booking for a specified retreat.
  • All prices are quoted based on twin sharing (bring a friend/partner/family member), or on private/triple-sharing rooms where indicated. Prices do not include airfare.
  • Payments are strictly non-refundable unless otherwise stated. Since this is a special package involving multiple partners/suppliers, regular cancellation and refund policies do not apply.
  • We accept payments via Bank Transfer/UPI/Credit Cards
Travel Insurance
It is your responsibility to arrange appropriate travel and health insurance, as standard health insurance in India or your home country generally does not cover overseas trips, including our retreats. We strongly advise securing comprehensive insurance to protect against medical, financial, or other risks. Fit Escapades does not provide insurance and is not liable for any consequences of inadequate coverage.

Passports, Visas & Documentation
Participants are solely responsible for ensuring they have valid passports, visas, and any necessary certifications required for the countries they will be visiting during the retreat.

Third Parties
Fit Escapades is not responsible for the actions or omissions of third-party providers or independent contractors, including any changes to services that differ from what was advertised.

General Waiver
By participating in a Fit Escapades retreat, you acknowledge that you do so voluntarily and at your own risk. To the fullest extent permitted by law, you waive the right to bring any claims against Fit Escapades for any injury, loss, or damage to person or property that may occur during the retreat.

Damage to Property
By participating in a Fit Escapades retreat, you agree to take full responsibility for any damage you cause to the property, facilities, or any equipment provided during your stay. Fit Escapades shall not be held liable for any compensation or charges raised by the property for such damages. You, the guest, are solely responsible for covering any costs associated with repairing or replacing the damaged items, and you agree to settle any such bills directly with the property management. Fit Escapades disclaims any responsibility for resolving disputes related to such damages.

Photo/Video Release
By participating in a Fit Escapades retreat, you grant us the irrevocable right to use, reproduce, publish, and distribute any photographs, images, or videos in which you appear that are taken during the retreat. These may be used for commercial purposes related to Fit Escapades. You release us from any claims related to the use of these materials, including claims for libel or invasion of privacy.

Undertaking on International Spending
By booking a retreat/getaway with Fit Escapades, you hereby undertake and confirm that you have not exceeded the threshold of INR 7,00,000 for international purchases, including remittances, in accordance with the Indian government’s Liberalized Remittance Scheme (LRS) and the rules pertaining to Tax Collected at Source (TCS) for international remittances. It is your responsibility to ensure compliance with all applicable laws and regulations, and Fit Escapades shall not be liable for any non-compliance on your part.

Fit Escapades Trainers
Details about the Fit Escapades trainer/s will be provided closer to the retreat date. Trainers may be subject to change at our discretion.

Credits and Vouchers
All credits and vouchers issued by Fit Escapades are non-transferable and cannot be redeemed for cash.

Liability Waiver and Indemnity Agreement

  • Medical Disclosure: I certify that I am physically and mentally fit to participate in the retreat activities. I have disclosed any medical conditions, allergies, or dietary needs to Fit Escapades.
  • Assumption of Risk: I acknowledge that participating in the fitness retreat involves physical activities that may pose risks, including injury. I voluntarily assume all such risks.
  • Emergency Medical Treatment: In the event of an injury, accident, or illness, I consent to receiving necessary medical treatment as deemed appropriate by attending doctors called upon by Fit Escapades or the hotel and agree to bear all the costs.
  • Release of Liability: In consideration of being permitted to participate in the retreat, I release Fit Escapades, its owners, directors, officers, employees, and agents from any liability for loss, damage, or injury, including death, whether caused by negligence or otherwise.
  • Indemnification: I agree to indemnify and hold harmless Fit Escapades from any claims, damages, or costs, including legal fees, resulting from my participation in the retreat.
Governing Law
This agreement is governed by the laws of India and is intended to be as broad and inclusive as permitted by those laws. If any part of this agreement is found to be invalid, the remaining provisions will remain in full force and effect.

Acknowledgment of Understanding
I have read and fully understand this waiver of liability and indemnity agreement and agree to its terms freely and voluntarily.

Agreement to Terms

Partner Retreats – Terms & Conditions

Role of Fit Escapades

Fit Escapades acts as:

  • Travel & operations partner OR
  • Booking facilitator OR
  • Support provider
The Retreat Partner (“Leader”) is responsible for:
  • Program design
  • Class/workshop delivery
  • Schedule adherence
  • Guest experience delivery
  • Trainer performance
  • On-ground conduct
Liability

Fit Escapades is not responsible for:

  • Program changes
  • Trainer cancellations
  • Activity quality
  • Miscommunication from the Retreat Partner
  • Health issues arising from retreat activities
  • Injuries due to guest negligence
Payment, Pricing & Refunds
  • 100% advance required.
  • Cancellation rules will be as per Fit Escapades retreat cancellation policy unless a Partner-specific policy applies.
  • Partner-driven cancellations may result in date changes but not refunds unless explicitly stated.
Guest Conduct

Guests must follow:

  • Retreat Partner instructions
  • Trainer safety guidelines
  • Hotel/resort rules
Disruptive guests may be removed without refund.

Photography & Media Consent

By attending, guests consent to:

  • Shoot & capture images/videos
  • Use for marketing on Fit Escapades and Partner channels as stated in the media release policy in Retreats
